TERMS OF SERVICE

Scope and legal applicability

These Terms of Service (“Terms”) govern access to and use of the TheHappyBall website and online store (“we”, “us”, “our”).
They apply to all users and customers worldwide.

By visiting our website or making a purchase, you agree to be bound by these Terms and by all related policies published on savenor.com (including, without limitation, our Privacy Policy and our Returns, Warranty and Refund Policy).

Nothing in these Terms limits the non-waivable consumer rights granted under the applicable laws of your country of residence or delivery.

Capacity and accounts

You must be of legal age in your country of residence to make a purchase, or have the consent of your legal guardian.

You agree that all information you provide (email address, shipping address, payment details) is true, accurate and up to date.

You are responsible for keeping your account login credentials confidential.

TheHappyBall reserves the right to suspend or cancel any account in case of misuse, fraud, or violation of these Terms.

Products and descriptions

We use reasonable efforts to ensure that product descriptions, images and details are accurate and up to date.

However, colors and appearance may vary slightly depending on your screen or device settings.

Prices, descriptions and availability of products may change at any time without prior notice.

Orders and acceptance

When you place an order, you are making an offer to purchase.

The sales contract is considered concluded only when we confirm your order and proceed to ship it.

TheHappyBall reserves the right to reject or cancel orders, including but not limited to cases of:

  • lack of product availability,

  • suspected fraud,

  • obvious errors in price or description,

  • incomplete or inaccurate information.

In case of cancellation, any amounts paid for the cancelled order will be refunded.

Prices, taxes and duties

Prices are shown in the currency indicated on the website (by default, euros – EUR – for sales within the European Union) and are valid at the time of purchase.

In Spain and the EU, prices are normally displayed including VAT, unless otherwise stated.

Applicable taxes (such as VAT) are calculated and shown during checkout based on the delivery address.

For international orders outside the EU, customs duties, import taxes and other local charges may apply and will be the customer’s responsibility.

By completing payment, you confirm that you are authorized to use the selected payment method.

Payments

We accept the payment methods shown during the checkout process (credit/debit card, PayPal or others indicated at any given time).

Payment must be authorized and completed before the order is processed.

If payment authorization fails, the order will not be completed or shipped.

Shipping and delivery

Orders are normally processed within approximately 1 to 3 business days from payment confirmation.

Delivery times depend on the destination country, the shipping method selected and the carrier. Estimated delivery times will be shown during checkout.

Whenever possible, a tracking number will be provided.

The risk of loss or damage passes to the customer when the product is delivered to the address provided.

It is the customer’s responsibility to check the condition of the package upon delivery. If it arrives damaged or the product is incorrect, TheHappyBall must be notified within 48 hours so we can assist you.

Returns, refunds and warranties

Withdrawal / Change-of-mind returns

We offer a 14 calendar day period from delivery to return unused products in their original packaging, in accordance with the EU right of withdrawal for distance sales.

Exceptions: customized goods, hygiene or personal-use products once opened, or other items which, for health or safety reasons, cannot be returned.

Return shipping costs are borne by the customer, unless otherwise required by law.

Refunds will be made to the same payment method used for the purchase, within a maximum of 14 days from receipt and inspection of the returned item.

Legal warranty (where applicable)

In Spain and the European Union, the legal conformity warranty applies with the duration and conditions established by the applicable regulations.

TheHappyBall will comply with all applicable legal warranty and consumer protection obligations based on your country of residence and delivery.

TheHappyBall commercial warranty (90 days)

In addition to statutory consumer rights, TheHappyBall offers a voluntary 90-day commercial warranty from delivery, covering manufacturing defects.

Conditions:

  • the product must be unused, in its original condition and complete (with packaging and accessories).

Return shipping costs under this commercial warranty are borne by the customer.

If a manufacturing defect is confirmed, TheHappyBall will refund the price of the product (excluding shipping costs), or may, at its discretion, replace it with an identical or equivalent item, subject to availability.

Intellectual property

All content on the site, including text, images, logos, code and trademarks, is the property of TheHappyBall or used with the authorization of its owners.

You may not reproduce, distribute, modify, exploit or use any site content without TheHappyBall’s prior written consent, except where permitted by law.

Third-party tools and links

We may provide links or integrations to third-party websites and services (for example, payment gateways, shipment tracking platforms, etc.).

Use of these tools or third-party links is voluntary and at your own risk.

TheHappyBall is not responsible for the content, privacy policies or practices of such third parties.

Relationship with Shopify

Our online store runs on the Shopify platform, but all sales are made directly by TheHappyBall.

Shopify is not responsible for our products, transactions, or any disputes that may arise between TheHappyBall and customers.

Privacy and data protection

We process your personal data in accordance with our Privacy Policy.

By using our site, you consent to the processing of your data for:

  • order and shipping management,

  • customer support,

  • marketing communications (where you have consented),

  • fraud prevention,

  • compliance with legal obligations.

User reviews and submitted content

By submitting reviews, photos or other content (“User Content”), you grant TheHappyBall a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce and display such content.

You warrant that you own the rights to the User Content you submit and that it does not violate any law or third-party rights.

Errors, inaccuracies and omissions

We may correct typographical errors, pricing mistakes or description errors at any time.

If an order is affected, TheHappyBall may cancel the order, inform you, and refund any amount paid.

Prohibited uses

You agree not to use the website or services to:

  • engage in unlawful or fraudulent activities,

  • upload malware or malicious code,

  • breach or attempt to breach security systems,

  • bypass restrictions.

Violation may result in account suspension or legal action.

Termination

TheHappyBall may suspend or terminate access in case of violation of these Terms or applicable law.

Disclaimer of warranties

Except to the extent required by law, TheHappyBall’s services and products are provided “as is” and “as available”.

Limitation of liability

To the fullest extent permitted by law, TheHappyBall shall not be liable for indirect or consequential damages.

This does not apply where prohibited by consumer protection laws.

Indemnification

You agree to indemnify and hold harmless TheHappyBall from claims arising from:

  • your breach of these Terms,

  • your violation of laws or third-party rights.

Severability

If any provision is invalid, the remaining provisions remain in force.

Entire agreement

These Terms, together with all policies, constitute the entire agreement between you and TheHappyBall.

Assignment

You may not transfer your rights without TheHappyBall’s consent.

Governing law and jurisdiction

These Terms are governed by Spanish law, without prejudice to consumer rights.

Consumers in the EU may bring claims in their local courts or in Spain.

Changes to the Terms

TheHappyBall may update these Terms at any time. Continued use implies acceptance.
